TERMS & CONDITIONS

Placing an order implies that you have read, understood and accepted these Terms and Conditions of sale. These shall be the only terms applicable to the agreement thus entered into.

ARTICLE 1 – PRICES

The prices of our products are shown in Euros, including tax, and excluding postage and packaging.

The prices of products listed on the website are applicable at the time the order is placed.
We reserve the right to change our prices at any time.

ARTICLE 2 – THE CLIENT’S COMMITMENT

ART  2.1 – client market

The items for sale on the site www.nathaliederouet.com are reserved for individual purchasers.
No order can be passed with a view to resale, repackaging or modification without our prior consent in writing.
The client is responsible for providing the correct information when placing the order; we cannot be held responsible for such errors or for any costs incurred as a result.

ART 2.2 – legislation

The items offered for sale conform to current French legislation. Nathalie Dérouet.com cannot be held responsible for any non-conformity to legislation that applies in other countries. It is your responsibility as a client to check with the relevant local authorities that the import and use of these items does not breach any such local legislation.

ART  2.3 – export: customs and local taxes

For deliveries outside the European Union, customs duty, import tax and other state taxes might be applicable. These costs are part of the client’s responsibility and must be met by the client, who is also responsible for the relevant declarations and payments. We recommend that each client seeks the relevant information from the local authorities in his or her country.

ARTICLE 3 – ORDERS

ART 3.1 – the right to refuse an order

We reserve the right to refuse or cancel an order from any client with whom we have experienced payment difficulties from a previous order.

ART 3.2  - ownership

All items remain the property of Nathalie Dérouet until full payment is received.

ART 3.3 – acceptance of Terms & Conditions

Any order placed online implies the full and complete acceptance of the present Terms and Conditions. Confirmation of an order is taken as acceptance of these Terms and Conditions.

ARTICLE 4 - PRODUCTS

ART 4.1 – descriptions of products

The photos and descriptions of items and products for sale on the website nathaliederouet.com present, as faithfully as possible, the items that will be delivered to the client. The information provided allows the client to understand the essential characteristics of the items that he or she might wish to order.

Please note, however, that the craftsmanship inherent in the production of the ceramic items for sale on this site can inevitably lead to slight variations between the photograph image and the final pieces dispatched. Such characteristics prove the unique handmade nature and the craftsmanship involved in the items produced by Nathalie Dérouet.

Under no circumstances can such variations be the subject of legal dispute or complaint.

ARTICLE 5 – DELIVERY & INSURANCE

ART 5.1 – delivery costs

Postage and packaging (or ‘delivery’) costs are in addition to the price of the items shown on the website. Delivery costs are calculated according to the rates provided by the Business post service of La Poste, which Nathaliederouet.com uses for all dispatches.

The delivery costs are shown to in the basket once the client has selected the country  to which the items are to be delivered.

ART 5.2 - insurance

Delivery costs automatically include insurance, which protects you from loss or theft of the order during transport.

ARTICLE 6 – AVAILABILITY  & DELIVERY PERIODS

ART 6.1 - availability

The availability of each item is shown in the basket.

- If certain items are available, they will be delivered within 5 working days in Europe and within 3 days in France. Within 10 working days to other countries.

When the client confirms an order, this confirmation is taken as acceptance of the stated delivery periods.

- If any items shown are not in stock, they are currently in production and once complete, they will show on the site as being available to order.

ART 6.2 – availability error

Should a product become unavailable after your order has been placed that showed it as being in stock, we will inform you immediately by post or by email. Your order will automatically be cancelled and, if your account has been debited, you will be immediately refunded.

ART 6.3 – delayed delivery

Should a delivery be delayed for any reason, you will be informed by email. Should this occur, you have the right to cancel your order if it has not already been dispatched and you can request a refund of any payment already made.

ARTICLE 7 – PAYMENT & SECURITY

ART 7.1 – secure online payment

Your purchases can be paid for by bank card or by cheque.
Online payments are protected and fully secure thanks to our banking partner Groupe Crédit Mutuel ARKEA.

Article 8 – JURISDICTION

ART 8.1 – legal jurisdiction

These Terms and Conditions are governed by French law. In the instance of any dispute, the commercial court of Quimper shall have exclusive jurisdiction.

ARTICLE 9 – REFUNDS

An order will only be refunded in one of the following three instances: ART 9.1 – 9.2 – 9.3 below.

ART 9.1 – right of cancellation

You have seven days from the time of receiving your order to return the item if it is not suitable.
In this instance, you remain liable for the delivery costs; only the price of the item or items purchased will be refunded.
Returns must be made to: NATHALIE DÉROUET, Céramiste, 56 rue Anatole France – 29100 Douarnenez, FRANCE. The pieces must be returned in their original condition and in the original packaging in which they were dispatched.
Any items that are returned damaged, soiled or used will not be accepted for refund.

ART 9.2 – damaged items

We undertake to refund or to replace any items that have been damaged in transit, provided that the packaging shows no obvious wear and tear caused by the transport company.
If, however, the packaging is seriously damaged at the time of delivery, it must be clearly declared to the delivery personnel who should provide a written statement to this effect and take a photograph of the condition of the package. Following this declaration – and only if such a declaration has been made to the delivery personnel – the client can request compensation for the full amount of the damaged items. In this instance, the responsibility remains with the delivery company.
All deliveries are dispatched with an insurance option in order to protect from, and if necessary compensate for, such an incident.

ART 9.3 – delayed delivery

If the delivery timeframes given at the time of placing the order cannot be fulfilled and the client wants to cancel the order, he or she can request a full refund of the relevant items, if the order has already been paid for.
Any refund is made by bank transfer into the account used for the original online payment.

ARTICLE 10 – CONFIDENTIALITY

ART 10.1

Personal details (name, postal address, email and telephone details) given online are required in order to fulfil your order, after which time they are stored on a secure database. They are used only for fulfilling the order itself and for internal statistical analysis, or for sending information about Nathalie Dérouet.Com, but under no circumstances will your details be given to a third party. Under the law concerning data protection and the freedom of information, you have the right to access, modify, amend or delete any details about you. ARTICLE 11 – INTELLECTUAL PROPERTY RIGHTS

All items sold on this site are the exclusive property of Nathalie Dérouet, céramiste.
All text, comments, illustrations, photographs, ceramics and models shown on the website www.nathaliederouet.com are protected by copyright as well as by intellectual copyright, in France and throughout the world; therefore, under the laws governing intellectual property, only personal, private use of any such content is authorised, and this within the strict and limited provisions protecting intellectual property.
Any use of the ceramics of the photographs thereof for any purpose other than private, personal use must be agreed upon in advance and in writing by Nathalie Dérouet, who alone is authorised to grant permission.

ART 11.2 – reproduction forbidden

Any reproduction of the ceramics on this site is strictly and wholly forbidden. All collections presented on this website are protected by law, by copyright and by intellectual property rights. Any person not respecting this will be liable to legal proceedings.
